The information we provide below gives an overview of our approach to the processing of your personal data and your rights under the provisions of the data protection law.

1.     Categories of Personal Data

For the purposes of Processing described in para. 2 below, we process your personal data provided on our website, hereinafter referred to as Personal Data, such as:

·      Name, surname, date of birth, mobile phone number, e-mail address, (hereinafter referred to as Personal Data);

·      Order number, type of products ordered, payment information (hereinafter referred to as Order Data);

·      content of the comment made and its subject, content of the documents attached and sent to Linella, information sent by customers during surveys (hereinafter referred to as Communication Data);

·      Information regarding your use of the user account and the Website such as the date and time you access the Website, including the public IP address, public Device ID and similar data referring to you (hereinafter referred to as Monitoring Data).

Moldretail Group SRL collects personal data in the following ways: directly from you (provided on the website, e-mail, social networks or other means of communication), from traffic reports recorded by the servers hosting the website, from networks and through cookies or from third parties that communicate data to us in order to deliver the products to you (e.g., online sales platforms).

 

2.     Purposes of Processing

We process your Personal Data to the extent permitted or imposed by applicable law for the following purposes:

provision of goods and services offered by Linella, including actions specific to this activity, including to allow the best possible use of the Website and to obtain statistical information for the improvement of Linella services or for conducting surveys on Linella products and services (hereinafter referred to as Purposes related to the provision of services and operation of the Website);
secure management of the Moldretail Group SRL computer system and in order to avoid criminal activities (hereinafter referred to as Security and fraud prevention purposes);
allowing customers to create an account on our Website, place orders online and purchase products from the Linella online store. You can manage your account, benefit from special offers, make shopping easier and manage your personal settings (hereinafter referred to as Online supermarket purposes);
allowing customers to make suggestions and complaints regarding the services offered by Linella (hereinafter referred to as Purposes related to customers’ suggestions and complaints);
allowing suppliers to share their opinions and make comments on Linella’s business or to propose ideas for collaboration or to submit offers to Linella (hereinafter referred to as Supplier-related purposes);
allowing contacting and managing the contacts with potential Linella partners (hereinafter referred to as Purposes related to expansion partners);
allowing marketing activities (hereinafter referred to as Marketing purposes);
use of your Personal Data to send you news about our products and services, when you purchase a product from the online store or when you set up a user account. You can unsubscribe from these marketing communications at any time, quickly and easily. All you have to do is to click on the “Unsubscribe” link included in each newsletter and in the web-page that will open.
Based on the information you provide to us, you may be shown personalized offers on the Website (including social networks). These can be offers that you can directly benefit from on the Website, offers from third parties or products that we think would interest you.
When you participate in other promotional activities (raffles, contests), you may be asked to provide us with relevant information that will be used to administer these promotions or to receive the prizes awarded.
Using your telephone number by Linella or an authorized person to contact you in order to improve our services or services of our subcontractors/partners (e.g., in case of surveys regarding your interaction with Moldretail Group SRL representatives/authorized persons).

In order to be able to provide to you personalized offers as part of the Loyalty Program if you enroll in this program according to Article 17 hereof (Loyalty Program Purposes), we use the history of your shopping with the loyalty card in the Linella stores and on www.linella.md.

We use the Personal Data, as provided by you to Linella, for the purposes set forth herein.

 

3.     Grounds for the Processing of Your Personal Data

In general, the processing of Personal Data is necessary in order to carry out the activity specific to the purposes of Processing.

In general, you are required to provide your personal data in a mandatory manner, except in limited situations where we inform you that certain information is optional. If you do not provide the required data, the process may be delayed or even impossible. Please keep in mind that, in the case of the Loyalty Program, if you do not provide your personal data or do not give your consent for profiling, we cannot offer personalized offers or benefits to you.

In order to process your personal data, Linella relies on various legal grounds such as:

·        Consent:

a.          We can rely on your consent to use your personal data for certain direct marketing purposes. Such consent is deemed to be the legal basis for collection, processing and use of your personal data, as permitted by applicable law. You can withdraw your consent at any time by contacting us at the addresses specified at the end of this Privacy Policy or by accessing the Personalization page.

b.         At the same time, based on your consent, we keep track of your shopping history and once you log in to your account, we are able to display on the website some relevant recommendations or offers depending on this history and are able to perform analyzes in order to be able to identify/propose recommendations, offers or personalized benefits as part of the Loyalty Program for the cards validated in online format or in the Linella stores. If you withdraw your consent to profiling using the Communication Preferences page, you will still benefit from all offers on the website (generally applicable), however they will not be displayed depending on their relevance to you and you will be able to use the card in standard mode only.

At the initial stage of the loyalty program, the data collected from you have little relevance for the purpose of profiling. As we collect more data on your shopping history, the relevance of the personalized offers or benefits we offer to you also improves.

Performance of a contract or taking steps to execute a contract:

Processing is necessary for the performance of a contract to which the data subject is a party or to make the necessary steps to execute a contract between you and Linella (e.g., in the case of expansion partners this means collaboration contract, in case of customers this means sale and purchase contract, in case of suppliers – supply contract). For example, if you use our services to place an order online, we will use your Personal Data to fulfill our obligation to complete and administer that order in accordance with the contract we have made with you. Also, the processing of your personal data may be necessary to take steps before executing an eventual contract, provided that you are a potential partner and want to contact us for a possible commercial collaboration;

Legitimate interests:

We may use the information for our legitimate interests, such as providing the most appropriate content of the Website, marketing, improving and promoting our products, services, and content on our Website, and for administrative and fraud detection purposes.

                    4. Retention periods

Personal data processed for the purposes stipulated herein shall be retained only as long as necessary, during the existence of your account and subsequently, during a transition period (for example, for receiving a response to your request, for delivery of goods, for issuing invoices) or for any other longer period during which Linella has the legal obligation to archive the Personal Data.

If a court action is initiated, personal data may be kept until the end of this action, including any recourse periods, and later such data shall be deleted or archived, according to the provisions of applicable law.

In principle, we keep your personal data for the period required or permitted by applicable law. Subsequently, we remove/delete your personal data from our systems and records and/or take steps to anonymize them so that you can no longer be identified based on them. In all cases, personal data in contracts, communications and other identified documents may be subject to legal retention requirements, which require, in principle, retention for up to 10 years. Any other Personal Data shall be deleted, in principle, within 6 months from the deletion of your user account or from their collection through the Website, except for the Order Related Data, which may be kept for up to 3 years from the transaction date or, as the case may be, for a period necessary for the fulfillment of legal obligations (including if we are obliged to do so by a court decision) or if it is necessary for security reasons, prevention of fraud, litigation or abuse.

                    We use appropriate systems and procedures to protect and secure the Personal Data you transmit to us. We also use security procedures and technical and physical restrictions on accessing and using personal data on our servers. Only authorized personnel can access personal data while working.

                    If you have given your consent to certain Processing activities, you may withdraw this consent at any time with future effect. Such withdrawal shall not affect the lawfulness of Processing prior to the withdrawal of consent.

The information includes, but is not limited to the purposes of the Processing, categories of personal data affected and recipients or categories of recipients to whom your Personal Data have been or will be disclosed. You have the right to obtain a copy of the Personal Data processed. For additional copies, we may charge a reasonable fee based on administrative costs.

2.   Right to rectification: You have the right to ask us to rectify your incorrect personal data. Depending on the purposes of the Processing, you have the right to complete incomplete Personal Data, including through an additional statement.

3.   Right to erasure (“right to be forgotten”): You have the right to ask us to delete your personal data, by accessing the Customer Relations service by phone or by sending an email to relatiiclienti@linella.md.

4.   Right to restriction: You have the right to request the restriction of processing of your Personal Data. In this case, the respective data will be marked and can be processed by us only for certain purposes.

5.   Right to data portability: You have the right to receive your Personal Data, which you have provided to us, in a common structured format that can be read by devices, and you have the right to transmit these data to another entity without objections from us.

6.     Right to object: You have the right to object to the processing of your personal data by us, for reasons related to your situation, at any time, and we may be asked not to process your personal data. If you have the right to object and exercise it, we will no longer process your personal data for that purpose. Exercising this right does not involve any cost. This right may be invalidated especially if the processing of your personal data is necessary for the formalities related to the execution of a contract or for the performance of an already executed contract.

The rights set forth above are exercised based on an application made in writing, dated and signed, sent to Linella’s postal address: sos. Muncesti 121, Chisinau – Attn. Data Protection Officer. You can specify in the application if you want the information to be communicated to a certain address, by e-mail or through a mailing service to ensure that the delivery is made only to you personally. Please note that before accepting any such application, we reserve the right to verify your identity to ensure that the request comes from you.

Linella will provide the requested information within 30 days upon application receipt using the communication method specified in your application.

Please note that the above rights may be limited under applicable national data protection law. Moldretail Group SRL, as a data controller, remains the central contact point in order to exercise these rights.

You also have the right to file a complaint with the National Authority for the Supervision of Personal Data Processing.

7. How do we process children’s personal data?
